Terms of service and equipment sale conditions

1. These terms

These terms govern your use of this website and, together with the written quotation or order confirmation issued for a specific transaction, the supply of equipment and services by BHE-Group LLC, 32 Washington Pl, New York, NY 10003, USA (“we”, “us”). Where a signed contract or order confirmation conflicts with these terms, the signed document prevails for that transaction.

2. Website content

Information on this website is provided for general guidance. Capacities, dimensions, utilities requirements and delivery lead times are indicative until confirmed in a written quotation for specific equipment. Photographs may show equipment representative of a category rather than the exact unit offered; images of second-hand machines are of the actual unit unless stated otherwise. Image licensing is documented on our credits page.

3. Quotations and prices

• Quotations are valid for 30 days unless stated otherwise, and are subject to availability of the equipment quoted.
• Prices are exclusive of taxes, duties and import charges unless expressly stated.
• Delivery and installation scope is exactly as written in the quotation. Anything not listed is not included.
• Obvious errors in a quotation may be corrected before an order is accepted.

4. Orders and acceptance

An order is accepted when we confirm it in writing or when we begin performance, whichever happens first. Where equipment must be ordered, prepared or refurbished specifically for the customer, cancellation may be limited and deposits may be non-refundable; any such condition is stated in the quotation.

5. Second-hand and refurbished equipment

Second-hand equipment is sold with the condition report issued for that unit. The condition report describes the inspection carried out, parts replaced and any known wear. Cosmetic wear consistent with the report is not a defect. Where a unit is sold “as seen”, no functional warranty applies. Full details are set out in our returns and warranty policy.

6. Delivery, risk and title

Delivery terms (including Incoterms where applicable) are stated in the quotation. Risk passes as provided in those terms; title passes when payment is received in full. Delivery dates are estimates made in good faith and may be affected by manufacturer lead times, transport availability and customs clearance.

7. Installation and site responsibilities

• The customer provides safe access, a suitable installation position, and appropriate power, water, drainage, gas, steam and ventilation unless the quotation includes them.
• Floor strength and structural suitability for heavy machinery are the customer's responsibility unless we have carried out and documented a structural assessment.
• Third-party work such as electrical installation, gas fitting or building alterations is performed by the customer's qualified contractors unless expressly included in our scope.

8. Warranty

Warranty terms for the equipment supplied are stated in the quotation and summarised in the returns and warranty policy. Warranty covers repair or replacement of defective parts under normal use and does not cover wear parts, damage from incorrect utilities, limescale, misuse or third-party modification.

9. Liability

To the maximum extent permitted by law, our total liability arising from a transaction is limited to the price paid for the equipment or service concerned. We are not liable for indirect or consequential losses, including lost profit, lost linen, lost production or downtime. Nothing in these terms excludes liability that cannot lawfully be excluded.

10. Intellectual property

The text, layout, design and code of this website belong to us or are used under licence. Manufacturer names and trademarks mentioned on this website belong to their respective owners and are used for identification only. You may not reproduce substantial parts of this website without written permission.

11. Acceptable use

You agree not to misuse this website, including by attempting unauthorised access, submitting false enquiries, scraping content at volume, or using automated means that degrade the service for others.

12. Governing law

These terms are governed by the laws of the State of New York, USA, and the courts of New York County have exclusive jurisdiction, unless mandatory consumer-protection law in your country of residence provides otherwise.
